Let me start with a brief story of my own personal experience with a very distressed property. Maybe you can relate in some ways. It was 2007 the housing market was about to have one of it’s largest crashes in the past century. I was new and naïve, but I was on fire! I Was buying up properties at speeds of up to one per month. This was made possible at the time due to the banking regulations being pretty lose to say the least. These same banks that were having no problem lending out money at this moment were about to flip the switch in the other direction…..TO OFF.  At this time, I was right in the middle of a full rehab on one of my new investment properties. The banks promises to fund the next stage of my project vanished in to thin air. The project was stopped and the house was forced to sit empty.  Vandalism and weather started attacking the property. This was becoming one of the most stressful situations of my life.

So, what did I learn?? I learned a lot! Besides learning that collage is not the only expensive form of education lol.  At Least I was able to walk away with a ton of useful information.

Some of the things I learned, that relate to this topic of distressed properties are.

*Time is not on your side. Every day is costing you money in some way.

*The problem won’t fix itself. Putting it off just pushes it down the road for a later time.

*The condition of the property gets worse faster than you think.

*Stress will chase you even in your sleep.

I’m not going to say “I’m glad I had this experience” but I am grateful. This has ultimately given me the knowledge,  that now I can share with you. The point of this story was to hopefully relate just a little bit, to whatever situation you are dealing with. It doesn’t matter what circumstances have gotten you into this situation. It doesn’t matter if they were your fault or casued by some other reasons. What matters now is taking the next steps to finding some solutions. What is Foreclosure?  It is a legal process in which a lender attempts to recover the balance of a loan from a borrower who has stopped making payments to the lender by forcing the sale of the asset used as the collateral for the loan.

So basically, your property payments are behind. There is probably a good explanation why….but the bank probably isn’t interested in hearing your story.

So, let’s figure out how to get this situation under control. If you are reading this and you are about to miss a payment or have the pre-foreclosure stages starting. There is a good chance by catching up on some things, all these problems can be resolved. A quick sale or some other strategies may work for you depending on the circumstances.

Even if you have been in the foreclosure process for a while now there still could be some way to prevent a total loss or default. Every situation is unique so we need to go over all the details.

Time is very important when trying to come up with solutions for foreclosures. Everyday that goes by is another day that the bank sees your payments as being late.

Estate Recovery Programs

When Medicaid comes knocking

Below is some information strait off the PASSi website on describing what estate recovery is. It doesn’t sound very friendly or helpful if you ask me. But we need to beware of it, we all know somebody that is getting older and chances are if you haven’t experienced this all ready, you might.  

“What Is the Estate Recovery Program?

The law requires every state to try to get back the money that the state pays for someone’s Medicaid benefits. The state can then use this money to pay for long-term care for other people.

For instance, suppose Pennsylvania pays $100,000 from Medicaid for a person’s care. That $100,000 might include payments for nursing homes, in-home care, hospital stays, or prescriptions. In that case, the government needs to recover $100,000 from that person’s estate.

An estate is just the property left over after a person dies. For most Medicaid recipients, most of the money comes from selling the person’s house. Houses are usually the largest asset a person has if they qualify for Medicaid. Typically, the recovery program is not concerned with your personal possessions.”

The passing of a loved one or their situation of not being able to live in their home any longer is a meaning full transition in life. This should be a time of compassion and help. Unfortunately, in some cases it pushes these stressful responsibilities on to care takers and family members.

One common thing I hear is –  “now I have to deal with selling this property and I get no benefit at all and nothing in return. All the money has to go to Medicaid! This has been such a stressful nightmare”
